Connect is a public and free meeting space where creators and national institutions can introduce innovations protected by industrial property rights to parties interested in using or commercially exploiting them.
This document consists of an agreement describing the terms and conditions of use to users of Connect, developed by the National Institution of Industrial Property (INAPI), which can be modified by INAPI at any time. For this reason, users are obliged to review them periodically. Connect provides public use of its information, free of charge to users and interested parties. The content of the website is considered general information for the interchange and possible commercialization of industrial property rights and should not be considered a suggestion to acquire certain intangible assets..
INAPI Connect is completely free of charge. Users are free to choose the content and material which best represents their protected creations.
The support material referenced in the “Technology Transfer Guide” is intended to serve as general guidelines and under no circumstances do they replace the professional advice that users should seek in this type of operation. The transfer or licensing of industrial property rights such as invention patents is a judicial and commercial process. Due to their length and complexity, they are not addressed by Connect.
The guides, advice, and suggestions provided by INAPI Connect, regarded as tools in these cases, as well as their format, content, availability, or usage limitations, can be modified and updated by INAPI without prior notice. The contents of an invention patent published in Connect is the responsibility of Connect users. INAPI reserves the exclusive right to publish and/or remove patents from Connect for any reasons it deems convenient.
Connect only facilitates contact between patent titleholders and possible parties interested in their use or acquisition. INAPI does not guarantee the veracity or accuracy of the descriptions of the industrial property registrations published on Connect, just as it does not guarantee the propriety or validity of the industrial property right.
The negotiation regarding industrial property rights takes place exclusively between the titleholder of the right and the party interested in using or exploiting it. INAPI will, under no circumstances, take part in the negotiation process.
Hence, Connect does not create any legal or contractual relationship whatsoever between INAPI and the negotiating parties. INAPI does not take responsibility for any misuse of the content on behalf of third parties using Conecta.
The contents of this website are property of the National Institute of Industrial Property (INAPI). Its use, publication, reproduction, and/or distribution are authorized with the consistent inclusion of the source and link to the main page of this website. This does not include the information provided by its users, in which case its use must be with their authorization.
It is not permitted to undertake any commercial exploitation of the contents and intangible rights included in Connect without express written authorization from INAPI.
The name National Institute of Industrial Property or the acronym INAPI correspond to the name of a public service. For this reason, its use without the express authorization from said authority can be subject to corresponding legal action.
The registered user authorizes INAPI to use, publish, make available, modify, adapt, reproduce, and display the texts and images uploaded to Connect.
INAPI will be the proprietor of the industrial property rights of all information contained in the Connect platform, as well as their layout and graphic design, promotional and explanatory videos, drawing, photographic material, audio recordings, and all supporting material and guides, as well as any information uploaded by the users in accordance with the previous paragraph. For this reason, no material contained in the INAPI Connect platform can be copied, reproduced, re-published, modified, edited, altered, installed, published, transmitted, saved, or distributed in any form, or be used on another website, without the express authorization of INAPI and the source and a link to the main page of this website included.
Under no circumstance can the information provided by users be used without the corresponding authorization.
Due to the number of users taking part in Conecta, INAPI cannot verify that each of these users have the right or the possibility to transfer the patents registered with Connect.
The users of Connect acknowledge that they hold sole responsibility for the content of their advertisements and the industrial property publications they upload to INAPI Connect. They also guarantee that these do not violate any copyright, industrial property rights, or other rights held by third parties. In the case of legal action or claims directed at any content, the respective user should take responsibility for it and ensure that INAPI is not affected by any costs or damages.
The services provided by INAPI through INAPI Connect are not subject to any guarantee or condition, whether express or implicit. INAPI is not responsible for the negotiations or transactions between parts using INAPI Connect as a means of contact.
INAPI does not guarantee that the services provided via INAPI Connect are continuous, uninterrupted, timely, secure, or free from error. INAPI can also not corroborate the trustworthiness of its users, the accuracy of the information provided by these, nor the veracity and/or quality of any material published on Connect (texts, photographs, or other audiovisual material).
Users are exclusively responsible for the terms and conditions specific to a transaction, whether local, national, or international.
Users acknowledge that INAPI:
Is not party to nor a participant in any transaction. Does not have control over the terms or content of negotiations or transactions resulting from the use of Conecta. Does not specify, determine, or set prices or conditions of transactions, nor is it involved with the quality, security, compliance, legality, or accuracy of the descriptions of published patents. Is not capable of obtaining information that supports the competence of patent titleholders. Does not take any responsibility for payment or charge for a negotiation or transaction resulting from the use of Conecta. In the case of any controversy related to a negotiation or transaction, the user extricates INAPI and its officials from any claims or damages.
The user acknowledges that INAPI is not responsible for direct or indirect damages resulting from the use of the Connect platform, and thus INAPI is not accountable to users or third parties for loss of profit, loss of income, loss of business opportunities, damages, expenditures or expenses incurred for any reason (including negligence), stemming from errors caused by the malfunctioning of the platform, website, or server, or any virus affecting one or more user devices as a consequence of accessing any INAPI website, the cancellation, for any reason, of INAPI user accounts, or for force majeure, including decision by administrative authority, strike, war, or natural disaster preventing the normal functioning of the platform.
In general, the user accepts and acknowledges that INAPI is not responsible for damages stemming from any interruption, suspension, or termination of the Connect platform.
