Collective trademark

Collective trademark

Distinctive sign able to be represented graphically, to be used collectively in order to distinguish the origin, material, manufacturing procedure, or other common characteristic of a good or service, produced and/or provided by the members of an association. Collective trademarks make it possible to differentiate these products or services in the market from those produced or provided by third parties outside the group. This type of trademark cannot be transferred or assigned.

Certification trademarks

Certification trademarks

Distinctive sign able to be represented graphically, signifying that a product or service fulfills certain pre-established standards and has been guaranteed by a certification authority. Normally, the certifying body is a certifying company or expert authorized to perform certification. Some examples of what can be certified are: (i) one or more specific characteristics of the product or service to which the trademark is applied, or (ii) that the products or services to which the trademark is applied complies with a set of pre-established standards. This necessitates prior and continuous inspection on behalf of the certifying body.

Expressions or phrases used to publicize a previously registered trademark. Accordingly, in order to request protection for a slogan, an applicant must first have a registered trademark, and the scope of the slogan will depend on that of the registered trademark the slogan is meant for. In principle, they are used to promote a product, highlighting certain qualities or attributing a positive feel to the product. They are only denominative and are not included in a label.
