Once a trademark is registered, it can be sold to a third party.
The sale of a trademark may be done by a private instrument signed before a notary. However, in order to be valid in respect of third parties it must be filed before INAPI and recorded in the Registry.
The recording of a trademark registration is done through annotations, which may be total or partial, depending on whether what is sold is the entire registration (Total Assignment Form) or just one or more classes of products and/or services if the registration has more than one class. (Partial Assignment Form).
The payment of transfer rights is 1 UTM, for each registration to be assigned.
